The Supreme Court, on Friday, affirmed the election of Governor Rochas Okorocha of Imo State.
The governor had filed an appeal challenging the decision of an Appeal Court in Owerri, the state capital, which granted a joinder to his predecessor, Ikedi Ohakim, in an appeal instituted by a candidate of the defunct Action Congress of Nigeria, ACN, Senator Ifeanyi Ararume, challenging his election.
Justice Clara Ogunbiyi, delivering her judgement on Friday, ruled that the Appeal Court over-reached itself by assuming jurisdiction on the matter, thereby giving Ohakim a second opportunity to challenge the election of Okorocha through the back door.
The Supreme Court also held that the lower court’s judgement was an attempt to give Ohakim the opportunity to re-litigate a matter that had long been settled by a properly constituted election tribunal.
The governor criticised Ohakim for embarking on an endless litigation.
