Governor Sullivan Chime of Enugu State has again lost his case against the Guardian Newspaper Limited and his opponent in the 2007 governorship election, Okechukwu Ezea.
Chime dragged Ezea and the newspaper to court seeking N1.5 million as damages.
He claimed Ezea defamed his character when he (Ezea) alleged that the governor planned to kill him. The governor said the defamatory statement was made at a press conference in Abuja.
Chime claimed this was reported on page seven of the Guardian newspaper of August 14, 2007.
Justice Kazeem Alogba of a Lagos High Court had ruled out Chime’s suit for lack of merit and asked the governor to pay a cost of N100,000.
The governor challenged the judgement at an appellate court.
On Friday, November 14, 2014, the Court of Appeal, Lagos Division, again dismissed Chime’s appeal. The suit was struck out for lack of merit.
Justice Rita Pemu held that the governor ought to have presented witnesses who could back up his claim of defamation.
